I need some advice...

About a month ago there was an ad on SMC that offered a couple of Festool polo shirts for anyone that was willing to pay the shipping.  The gentleman offering the shirts had received them from a sales rep I think and couldn't use them.  I gladly paid the shipping and looked forward to getting my shirts.  A couple of weeks went by and no shirts.  I emailed the gentleman and he told me that he had shipped them UPS and that they had been delivered on 4/23.  He had UPS call me to verify.  In my conversation with them I found out that they had delivered them to the wrong address.  I went to this address earlier in the week to retrieve the shirts and they would not answer the door.  I left them a note on their mailbox explaining the situation and asked them to call me...no call.  I finally spotted them outside today and stopped by.  I could tell as I walked up to the stoop that the lady recognized me from knocking at their door.  I politely explained the situation and inquired about the package.  The reply I got was "Package?  We haven't seen a package."  I mentioned that UPS had confirmed that they had left the package by the door on the 23rd, "Nope.  I don't remember seeing any box."  I haven't seen such bad acting in a long time.  I called UPS and emailed the gentleman from SMC to let them know what had happened.  My fellow Creeker was generous enough to refund my money for the shipping (something I didn't ask him to do).  Should I pursue this any further with the recipients of the package or should I just let this be?

If the fella on SMC shipped them to your address, then it's UPS's fault it went to the wrong address.  They don't know what was in the box.  Heck, tell them it's something extravantly expensive and/or sentimental.  They should have loads of litigious-minded investigators who should take up this task.

However you look at it, the "recipients" are retaining possession of something which is not rightfully theirs, which is classically defined as "theft".

I'll bet one call or letter from a UPS executive / lawyer would set things straight.  I assume these are not neighbors with which you want/need to cultivate any further relationship.

UPS needs to make it good. They are the ones that screwed up. Unless that address on the package was incorrect.

Threaten UPS with legal action & tell the home owner you are going to the Rozzers unless they give up the parcel that you know was delivered to them.  Might just be enough for them to say sod it, have them back & p#*ss off.

To be honest Russ,

I would let it go. Consider it a gift to them. You will feel better about it then. It is not worth getting upset over. Let UPS take care of it.

Tsk tsk... Remember, they probably have YOUR address on the box, and apparently they're of lower moral character.  Don't get into a vandalism contest-- You'd probably be much more upset if they come trash your place feeling full of vengeance.  Let corporate handle it.  As they say, "What can Brown do for you?"

Oorrr.... follow the sage approach of 'Marsellus Wallace' and get some friends to head on over with a blowtorch and a pair of pliers...  And get your shirts back!

Everyone is seriously over reacting. 
It is a couple free shirts.
Let the shipper keep his money and forget about it.
How much trouble do you need?

Besides, is it possible the people didn't get the shirts and don't know what you are talking about.  If UPS made one mistake, they could have made two.
Fortunately it just isn't important.

I can't lie, I was really looking forward to having those shirts.  That's not what bothers me about the whole thing.  For crying out loud I'm not even out any money since the sender refunded the money I sent for shipping.  The fact that I found myself standing in front of this lady knowing that she was lying to me really got under my skin.  It didn't help that I had tried repeatedly to contact  them throughout the week and they ignored every one of those attempts.  Oh well, I guess I'll heed the advice that some of you have passed on and in the name of Paul McCartney I'll just let it be.

Hmm... It reminds me of an "experience" I once had, where I bought an expensive camera on the German fleabay, and never got anything. Neither fleabay nor anyone else wanted to help sort it out, as it would hurt their reputation and the like. I was really mad, but as my wife told me, get over it, it's only money, and lesson learned.
But never the less, it seems to be a bad act from that neighbour. But maybe they need the tshirts even more than you, poor fellas. I too think UPS should come up with a fresh set of Festool tshirts for you accompanied by an appology. How on earth they will get them is another story. If I ever stumble over one, I'll mail it to you for free as a matter of good will.

Btw. very true Harry, but it shouldn't take away the possibility of acting within a reasonable level oneself.

Back in the high school days one of our classmates did the flaming dog poop thing and got charged with Arson.  A bit of over kill by the police but it is on his record, forever as Arson.

If it was left on the doorstep by UPS w/o a sig., I'm afraid you are SOL.  At the company where I work, it is a private drive and not on any map,  it's called 49 Robin DR.  Right around the corner there is a Robin RD.   And on that Rd there is a 49 Robin RD.  Because we are not on any map these people at 49 Robin RD get our parcels all the time.  The man who lives there is kind of a  jerk and he was frustrated after a period so he sought legal advice.  His lawyer told him that if it was left on your property and you did not sign for it, legally it is yours.  
I found out the hard way when I had LL Bean deliver a Xmas gift to his house and he kept them.  Same thing as you.  When I questioned him he denied seeing it and told me to get off his land.  Done deal.  He's done it countless times, even keeping a load of 2 X 4's and drywall!
It's best to deal directly with UPS or the seller.

I had my CT22 delivered today and was expecting them to leave a note to where I could pick it up the next day.  Instead, on the Fedex website, I see this: "Left at back door. Signature Service not requested".  I was at work so had to leave early to get home to make sure nobody snagged it.  When I got home there was nothing in sight at any of my doors.  So I called Fedex and they were trying to track down the driver.  I was on hold and then I heard the doorbell ring.  It was my neighbor a few houses down who had got the packages.  I keep to myself most of the time, so it was the first time actually meeting this neighbor.  Nice to know he is an honest guy.

That is exactly the reason why I have my personal packages delivered to my office. This method works as long as the sender does not mind shipping to the address that is different than the billing address on my CC. A few months ago I ordered a Fuji HVLP system. Even after several conversations with the seller we could not come to an agreement. I did not want to risk loosing an expensive package left at my door unprotected. Seller felt that it is too risky to ship to my office instead my home. (Phelps Refinishing did not have this issue and I had my Fuji delivered to the office a few days later).
What I am trying to say is that there is some risk involved with "mail order" type transaction. For the seller and for the buyer.

IMHO, It's not cool to have personal packages delivered to your work place.  First off, you are burdening the receiving personnel with a higher volume of packages.  I like to live by the motto "What if everyone (at work) did this".  This is tantamount to having them pick up your dry cleaning.  Not to mention the security issues being dumped upon them. 
Of course, if you're self employed and/or have a really small staff this is all moot.

That's very generous of you and completely not necessary.  I'll be happy to pay for a FOG shirt if they end up becoming a reality.  BTW, I've always wanted to ask, how far are you from Jamestown?  At the beginning of the school year we talk quite a bit about the Powhatan Confederacy and the development of Jamestown.

I am about 1.5 hrs from Jamestown, 1.5 hrs from Colonial Williamsburg, 2.25 hrs from Washington, DC.    The you have all the Civil War battlefields, etc.  It was quite a change moving here from Tucson, AZ (where I was born) when I was 10.

If you ever get over this way, please let me know!
